After the adoption is finalized, the stepparent gains the same rights and duties as a biological or legal parent, including authority over care, schooling, medical decisions, and support. In most cases, the other legal parent's rights must be ended first, either voluntarily or by court order.

For families, that can bring stability during a stressful time. It can also permanently change parental rights, child custody, inheritance, and who has legal standing to make decisions for the child. In Texas, stepparent adoptions are governed mainly by Texas Family Code Chapter 162 and usually require a court review of whether the adoption is in the child's best interest. If the child is age 12 or older, the child's consent is often required.
